Article 74 – Council of Ministers

  • CoMs with PM at head to aid & advise President
  • President can ask for reconsideration
  • After reconsideration → President must follow advice
  • Advice of Ministers cannot be questioned in court

Article 75 – Ministers

Appointment

  • PM appointed by President
  • Other Ministers → appointed by President on PM’s advice

Strength

  • Total Ministers ≤ 15% of Lok Sabha strength

Disqualification

  • Defection disqualified member → cannot be Minister

Tenure

  • Hold office at pleasure of President

Responsibility

  • Collectively responsible to Lok Sabha

Oath

  • Administered by President

Membership Rule

  • Must become MP within 6 months
  • Otherwise → cease to be Minister

Salary

  • Determined by Parliament

Article 76 – Attorney General

  • Provision for Attorney General of India

Article 77 – Conduct of Government Business

  • All executive actions in name of President
  • Orders issued in President’s name
  • President makes rules for:
    • Business transaction
    • Allocation among Ministers

Article 78 – Duties of Prime Minister

  • Acts as link between President & CoMs
  • Communicates:
    • Decisions of CoMs
    • Information required by President
